Sarawak has filed a petition in Malaysia’s Federal Court challenging the constitutionality of three federal petroleum laws, arguing they infringe on the state’s sovereign rights to offshore oil and gas resources under the Malaysia Agreement 1963 and the Federal Constitution.
The state contends the laws, originally for Malaya, were extended during a 1969 emergency later annulled, and that its legislative authority over seabed resources was transferred by the British on Malaysia Day.
The dispute arises as Petronas seeks judicial review of state regulations, prompting Sarawak to assert its constitutional right to a Federal Court ruling.
The court will hear Petronas’s application on March 16.
