In a November 2025 ruling, Maharashtra’s RERA clarified that a conditional occupation certificate (OC) does not legally allow builders to hand over possession until all conditions—like obtaining a Section 270A water supply certificate—are fully met.

A conditional OC is not a final, valid OC under RERA, and builders cannot use it to justify possession.

Homebuyers are advised to wait for a full, unconditional OC before accepting keys, as "fit-out possession" lacks legal protection.
